Taxes ugh.

Just did our taxes. For the first time in 5 years we qualified for EIC. But IRS rejected it saying one of our kids SS number has been already used for the EIC. Naturally we assumed xw had used dss.....but Dh asked her and she said no. That means someone has stolen one of our kids SS for the EI......

 

Now we have to send in a paper filing.....has anyone had to do this and how did it go?

I haven't had to do that, but did research the whole who gets the write off type stuff.  If DSS lived with you more than 50% of the year, then you get the write off, if not, she would get it this year.   (Unless a court order says differently.)  To forfeit that, the residential parent needs to sign form 8322    https://www.irs.gov/pub/irs-pdf/f8332.pdf 

 

Has she used him as a deduction before?

Their divorce was prior to 2008 so I think that form doesn't apply. But she claims she didn't claim the EI for him so it must have been stolen by someone else.

 

I just hope it doesn't take long to straighten it out. Although I feared we would be paying in and we will be getting money back so whatever. It will just be found money at this point. Also we assumed it was dss because of his mom....but when I read closer it said 'one of the children'....so someone one could have stolen Ds's.

Maybe call this number tomorrow? They might be able to give you more info.

Thank you. The IRS delayed refunds this year on EIC due to this fraud issue. Unfortunately they delayed until February 15 and I filed today....they said a return using that SS had already been filed and accepted. Not sure if they paid a refund or not.

 

Sad thing is someone has probably been using one or both of our kids SS for EIC for 5 years.

That's frustrating! I hope the individual just had a typo in the number and hasn't actually been using your son's information intentionally.

 

Our state has started requiring drivers license numbers this year to help verify correct identity. They also have a special phone survey they are requiring some people to take. It only helps with the state returns though.

 

My husband's identity was stolen this year, it will be interesting to see if we have difficulties with our federal return. We just filed last weekend so it's probably too early to have heard anything.

It might be identity theft, or it could very well be an error made by the IRS.

 

I'm an employer and have to deal with the IRS on a regular basis (especially since Obamacare began), and I can tell you that they make a LOT of errors. Our accountant and I have spent many hours dealing with their mistakes.  Just in the past few months, the IRS has claimed that the social security numbers provided for two of our employees were incorrect, even though they were absolutely correct. It is to the point that I'm more surprised when they get something right than when they get something wrong. 

 

Good luck and I hope you get it straightened out. An accountant who has experience dealing with the IRS can be a big help.

The rejection notice said to take off the already used SS ( even though they didn't indicate which one was already used) or correct it or if we were sure of the info we would have to file a paper return. So I don't know what happens once we do that....seems like once it gets processed as a paper return they are going to say the same thing....this kid has already been claimed.....prove he is yours?

 

Very frustrating.

I have friends that had to file paper returns for five years for this reason. They suspect (though can't know for sure) that their adopted child's birth parent was using the SS #. It's a hassle, but they did end up with the correct refund eventually. And then had to do the whole thing again the next year.

Well I am going to pursue it because it is a $2000 difference.. At first when we thought Ds's mom claimed him Dh told me we would just have to take dss off and live with it....but I did make him ask her and she says she did not do it.....so I am glad he asked!

We had this exact issue one year with DH's ex-wife.  We simply filed the paper return and we included a letter stating why we were claiming the dependents that we did.  We also included a copy of the divorce decree with the language highlighted so it was easy to find.

 

Our return was accepted with no problems and later that year, the IRS required the ex-wife to return part of her refund since she did not properly claim the dependents.

 

HTH.  It was annoying, but not too difficult.

Did you double check the number you entered? The one time we got that message I had entered my son's SSN incorrectly.

I did double check.  But H&RBlock had imported the numbers so I knew it had to be right....but yes I checked both boys numbers.

 

So I held for 30 minutes with IRS just to have them tell me I have to send in a paper return. When they get it they will determine if they need more info from me to prove we can claim him.  

 

Naturally when I went to print it to send in I ran out of ink.

 

Sigh.
