After the truck runs into the snowbank, Finicum initially jumps out with his hands up, but then (at the 6 minute mark in the edited version of the video) you can clearly see that "Finicum reaches his right hand toward a pocket on the left inside portion of his jacket. He did have a loaded 9 mm semi-automatic handgun in that pocket." ETA: Shorter version of the video here, along with a full transcript of the FBI's statement.
