sassenach Posted March 10, 2017 Share Posted March 10, 2017 If a tenant gives 30-days notice (on a month to month rental), and the move out date is 10 days into the month, does payment for the 10 days have to accompany the notice, or can that be paid on the first of the month as usual? I'm not in your state, but here it wouldn't have to be paid early, and I really doubt CA would be stricter than here. In some states it's legal for the landlord to initially ask for first and last month's rent, and I would imagine this could fall under that; however, I think you'd have to have that spelled out in the lease prior to the tenant moving in.
