Neither, this is about publishing work I did in ebook format only either by myself or with another publisher. I want to change publishers. Did your contract have a clause that said that your publisher has the right of first refusal in any future work you did? If you're talking about the original work you did with the publisher, you may not be able to switch. I agree that it sounds like contractual law.
