BlsdMama Posted February 15, 2021 Posted February 15, 2021 If there is no fault, it is reasonable to ask they be replaced? I had large bottles of tempera paint delivered today. The middle one wasn't frozen but all the rest are. So who is at fault? I'm assuming being frozen (solid) will affect the quality. #2 - DH ordered a beautiful pink peace lily for me for Valentines Day. It was scheduled for delivery on Friday. I fully admit our roads are crap. There IS a way through, but it's a bit round a bout. We had a snow plow guy come both Friday AND Saturday (and no snow) but the drifting out here is problematic. Both DH and DS shoveled several times to attempt to keep it clear and we were able to come/go (no 4x4 here) but no delivery as scheduled by FedEx either day. I assume by now the tropical plant is deader than dead. It was crazy expensive with overnight shipping from Harry & David's. Any recourse you think? Do I have the right to ask for that since weather is a little out of control. But I will say that I have had significant issues with my FedEx driver over years. We've had to call on him twice, including the day he delivered a laptop beside our garbage cans. (Yeah, I didn't find it amusing. Thank goodness our trash pick up guys are super conscious and careful guys. We were so thankful.) It is an ongoing thing. Sometimes, when it's not convenient to deliver, he calls and requests I meet him in town... If we have another guy? No issues. If it's the regular? Issues. To be fair, he has long hated our dogs and he was the first person I called to tell the dog had died. 4 Quote
gardenmom5 Posted February 15, 2021 Posted February 15, 2021 For starters, I'd call H&D's customer service and ask. Or look at their website. If the driver could get through - but didn't, it would seem to fall upon the driver and they would hash it out with Fedex as they do have a contract with them. This would also be another reason to complain about the driver - if your road was passable, but he didn't come anyway . . . especially if you had a perishable item. 1 Quote

Farrar Posted February 15, 2021 Posted February 15, 2021 I'm thinking the paint could be fine, but I don't know. I had this happen with a produce delivery once - produce totally ruined because it was frozen. The company refunded it. It was just a cost of business for them, clearly. Quote
Selkie Posted February 15, 2021 Posted February 15, 2021 I've had a few boxes of frozen produce delivered in the past couple weeks and have chosen not to pursue refund or replacement. The delay was caused by terrible weather and road conditions, so no one was at fault. Our FedEx guy does a great job and is very conscientious, so I know if there was any way to safely deliver, he would do it. Quote

I would look carefully at the label to see if they provide storage instructions. If those instructions are not there, then the manufacturer of the paints certainly knows. Check their website and if you do not find anything there, then I would contact customer support. I'm sure they want you to be satisfied with the product they manufactured. Corraleno Posted February 15, 2021 Posted February 15, 2021 Peace lilies are actually very tough, resilient house plants, and they tolerate low light, temperature fluctuations, and even lack of watering quite well. If it's just in a cold warehouse somewhere for a few days, it may be fine. I'd wait until it's delivered and see what kind of shape it's in. If it's half dead, I'd send a photo of it to H&D telling them that was what you received, and I bet they will send you another one. The paint might also be ok — I'd thaw it out and try it, and if there's a problem I'd call the vendor and ask for a replacement. If it came from Amazon, you can just list it as damaged and they will refund it or send a replacement. 3 Quote

As the daughter of a retired letter carrier whose entire route was on foot, this statement made my day, lol! My dad did his best to befriend all the canines, but sometimes people moved in with aggressive dogs that were not going to have it (one terrorized the entire neighborhood for a week, jumping fences, etc.).
