I almost started a thread about this yesterday. I really wasn't aware of this story before now, but apparently some people think she was in cahoots with the guy who filmed her in order to bring attention to her career. As far as I can tell, there is no evidence to suggest that is true.

I'm not surprised some people think that. Maybe to make themselves feel better for watching the video. But she has gone to great lengths to get the video taken down when it pops up so I can't imagine she was in on it.

I read an interesting article yesterday. Basically, the independent lawyer interviewed said that Marriott is attempting to reduce losses by arguing that she actually gained fame (thus earning potential) via the scandal, aka Kim Kardashian.

 

Andrews' attorney can rebut by saying that Andrews already had a thriving career and did not need to increase her notoriety in such a way. The down side is that will probably decrease the settlement amount, because she did not lose her career over the issue (tho word is that ESPN was pretty hard on her at first) and the event has not resulted in her reduced income stream.

 

Andrews' team will have to prove that she experienced tremendous emotional pain and suffering, and convince the jury that she deserves LOTS of $$$$ to make up for that. Yesterday's emotional testimony should help in that regard.

 

The things that boggles my mind is why Marriott didn't just settle out of court. They were in the wrong, clearly, and could have avoided having their gross error brought up again in national media, especially since the defense tactic they are taking is pretty disgusting, IMO.

So, was it a $75M mistake??

 

If it happened to me, I would say it was a $500M mistake, at least.  

 

It all sounds like so much money to me.  I have no idea how a dollar amount is awarded for this kind of lawsuit.

It's terrible on the hotel's part. If they don't have to pay out a large sum, it won't matter to them to get this situation fixed. The pay out has to hurt.

 

Hotels want/need their venues to be safe for women who are traveling alone or w/ kids. We don't want to feel like we're not safe in staying in something as nice as a Marriott. I travel alone a lot.

That is utterly DISGUSTING. Implying that it hasn't damaged her career but maybe helped is like asking a rape victim if she really liked it. DISGUSTING. 

 

If the hotel had argued that they weren't negligent, that would be one thing, but who the heck thinks that is an appropriate defense strategy to argue that it helped her career? The woman was sexually violated and continues to be every day that that video is available on the internet. 

 

Marriot ALLOWED their attorneys to do that? 

 

No more Marriot for me.
