Ruling in case of 10 yo boy killing father

Help me understand this. Police say they went to the home to arrest the mom ( boy's step mom) and found the nazi dad dead on sofa and mom and 5 kids inside. Why did they go to arrest her? Wy had she not called authorities? Where is the boy's bio mom?

 

What a horrible story.

I didn't get "step mom" out of the story.

She was arrested for "five counts of willful child endangerment and four counts of criminal storage of a firearm". From a brief Google, the latter is as follows:

 

a person commits

the crime of "criminal storage of a firearm of the first degree" if

all of the following conditions are satisfied:

(1) The person keeps any loaded firearm within any premises that

are under the person's custody or control.

(2) The person knows or reasonably should know that a child is

likely to gain access to the firearm without the permission of the

child's parent or legal guardian.

(3) The child obtains access to the firearm and thereby causes

death or great bodily injury to the child or any other person.

 

That is, if a child finds your gun because you didn't store it appropriately, and kills someone with it, then you have some criminal liability.

After reading the warrant-

 

The police went to the home because of the shooting (presumably) on May 1. The arrest of the mom came about two weeks later (warrant dated May 11, May 17, May 18). That is, they didn't go to arrest her and find the dead dad; rather, they went because of the shooting of the dad, and later got a warrant and arrested her because of the circumstances of the shooting.

 

It's not clear who called the authorities.

 

You were right about the bio & step mom - the warrant mentions custody issues.

Boy shot dad. Police called. While responding, police learned of children's access to guns and saw then deplorable home conditions.

 

Warrant was then sworn for stepmom.

 

As far as I can tell, they were responding to a call for the shot dad.

Yeah, that's what I got out of it.

 

Plus there was previous CPS involvement because of complaints by the bio-mom.

I know. Those poor kids. They were being abused.
