Am I out of line to request a refund?

Can someone give me some input..

 

On another forum, I posted an ISO for some items... a seller contacted me stating the following..

 

I have english and reading for grade 1, 3rd edition,

I have teachers books, wktxs, readers and the extras.

Also have spelling 1 te and wktx

Handwriting wktx

Askin $X plus shipping

 

I responded that it sounded great and I sent off payment.. The box finally arrived last night (there were shipping problems and a mix up)

 

There is no teacher manual for English, only 1 of 2 reading teacher manuals. All the work texts are partially used. While 1 work text is only missing a page, another is missing over 20, another over 40 and another is missing 106 pages! The readers were also missing, she did alert me to this possibility prior to the box arriving. The books are very dinged, one has a loose cover, lots of food stains...

 

I emailed to let her know I was surprised that the workbooks were used and about the missing items. She replied she was sure she had informed me and even if not, it was only "like 10 pages total".

 

I emailed her with the page numbers that the lessons start at and requested a refund. I feel very taken advantage of..

 

If I sell something, I am upfront about any part of an item that is used..

 

Am I out of line to insist on a refund? She said she might offer a partial but I asked for my full $ back, less shipping... and I could even insist on that because she quoted me $20 to ship and it was less than $10

I have bought there a couple times, did you use Paypal? If so, did you send it "personal-gift" or as a "purchase"?

If it was as a purchase, paypal may be able to help. I had to forward all emails between us and pics of the items I recieved to show they were not as described.

If you paid as "gift" Paypal can't do anything. But HSC does allow you to leave feedback, so even if you get it resolved I would at least leave a neutral feedback so others could be cautious.

In addition to learning PayPal is worth the fee ;) you should also realize that you failed to ask some necessary questions. She didn't tell you she had like new materials. She said nothing about the condition, so in my mind you are responsible for asking. That doesn't cover the stuff that just wasn't there. However, if condition is a concern you need to ask questions!

 

I try to always give detailed descriptions and even pictures of anything I think might be an issue to a buyer, but I never assume other sellers will do the same. I find people buying and selling things I would throw away all the time. People's standards vary greatly. Ask for lots of details to make sure what you are buying is really something you want.

I'm sorry you had that experience. I hope you can find some resolution.

 

I've learned the hard way to ask many questions about condition before purchase. I don't assume someone has the same perception of usable curriculum as I do.

And on HSC, doesn't it list the condition of the books? I think that's required?

 

I would request a full refund. Certainly.

ETA: I just realized she responded to your ISO instead of you responding to her listing.

I am sorry this happened to you.

 

If you buy mainly from the WTM For Sale board, it is so easy to get accustomed to trust everyone. Then, it is such a shock when someone takes advantage of you. It has happened to me, and it doesn't feel good.

 

I hope you can get your money back.

 

If a seller does not want to pay PayPal fees, I add them and let them know that I did.

 

I have only sent a money order once, and that was to someone who was a long-time WTM member, for only $12. I am not willing to risk losing more, and have learned that if the price is amazing, the books arrive in less than desirable condition.

 

I am shocked when people mail you dirty books they easily could have wiped off with a wet paper towel, and when I do it, it turns black! Yuck!
