Health insurance options in NY when company goes out of business? & Unemployment ?'s

Recommended Posts

You need to ask the unemployment questions with your state office of unemployment and labor. Laws vary from state to state. I know if you do move out of state, you will still collect unemployment from your state of employment.

As far as insurance goes, would you qualify for state insurance, at least temporarily? I'm not sure that a company filing for bankruptcy has to offer COBRA. If a company is out of business, the COBRA law is a mute point. With the federal subsidy, COBRA is quite affordable right now - you only have to pay 35%.

Here is the federal law about benefits when a company is facing bankruptcy: http://www.dol.gov/ebsa/newsroom/fsbankruptcy.html
