Crap. I think I've been scammed. :( (warning to Stampy fans!)

I think I've been scammed.  I ordered some Stampylongnose and iBallisticsquid pj's from Maker Shop on Dec. 2nd. This is the shop they direct their fans to for their merchandise, so I trusted that it was legitimate. My account has been charged the full amount, but nothing has shipped. I got a really weird email from them this morning (in response to an e-mail I sent them over a week ago), saying two my items were out of stock, but then why haven't I been refunded the money for those two? Their facebook page isn't making me feel any more optimistic about getting my order.

 

I had so looked forward to seeing my kids open their Stampy and Squid pj's on Christmas eve, and now that's probably not happening. :(

Ugh. Merry Christmas, right? :(

 

I filed a dispute with my bank (I'd ordered using my debit card), posted a message on Stampy's facebook page (which I know he looks at, but with the gazillion messages he gets each day, who knows if he'll see mine), and am leaving loads of comments on the Maker Store FB page about my experience (as are apparently dozens of others).

 

I'm as much a fan of Stampy and Squid as my kids are, and I'm just so disappointed that this is happening. :(

I don't understand why you think its a scam. You placed an order a little over a week ago, and the items haven't shipped yet because 2 of them are out of stock — are they not just waiting until those items are back in stock before shipping? This happens all the time, why would you assume its a scam?  :confused1:

And also this was the email I got this morning where they said "because the small and medium were out of stock... because we could not seperate the order and send what was available."

 

Really, that's how it was worded. As best as I can decipher from the e-mail, they couldn't send me just what they had (the one size that wasn't out of stock), but made no mention of either sending me the other sizes when they came back in stock, OR refunding me the cost of the out-of-stock items.

I haven't even gotten so much as a confirmation e-mail for my order. Typically websites don't charge you for their products until *after* it's shipped. My order has neither been confirmed, NOR shipped, and yet the money was taken from my account.

From reading the Facebook page, I think the people commenting on there are misusing the word "scam." Slow shipping + terrible customer service doesn't equal fraud, just really crappy business practices. There are similar complaints about Rainbow Resources every summer, lol.

 

Can you ask them to cancel your order and just reorder the ones they have in stock?

I think the concern is that they don't reply to most emails or Facebook/Twitter questions. There is no phone number, no email and no response. The money is withdrawn immediately and some people are still waiting on items from August.

 

I'm holding out hope for my items to arrive, but I would be panicked if I read the responses from other customers and couldn't afford to replace the gifts.

FTC rules:
 

By law, you must have a reasonable basis for stating that a product can be shipped within a certain time. If your advertising doesn't clearly and prominently state the shipment period, you must have a reasonable basis for believing that you can ship within 30 days.

If you can't ship within the promised time (or within 30 days if you made no promise), you must notify the customer of the delay, provide a revised shipment date and explain his right to cancel and get a full and prompt refund.

For definite delays of up to 30 days, you may treat the customer's silence as agreeing to the delay. But for longer or indefinite delays - and second and subsequent delays - you must get the customer's written, electronic or verbal consent to the delay. If the customer doesn't give you his okay, you must promptly refund all the money the customer paid you without being asked by the customer.

 

I had a situation like this. It was a different company, but with a pattern of this behavior.

They were impossible to deal with until I finally quoted the FTC rule and shared my plan to file a formal complaint if they didn't ship (with proof) or refund that very day. They suddenly found my product and shipped it. I should have contacted someone anyway, as they were scamming lots of people according to internet complaints.  http://www.business.ftc.gov/documents/alt051-selling-internet-prompt-delivery-rules

Just a reminder that this is why you should NOT use a debit card for on-line purchases. You have far greater protection with a credit card in the event items are not received.

 

(But, I agree with a previous poster that this doesn't sound like a scam - just slow service. It is a busy time of year.)
